In patient mobility, the European Court of Justice has opted for the ‘international state-of-the-art’ in case there is some disagreement between the home country (Member State of affiliation) and the place of treatment (Member State of treatment) concerning the question whether treatment is seen as ‘experimental’ or as ‘normal’.
